Former Director of Tay Ninh Department of Health accused of receiving 'kickback' of 1 billion VND

The Supreme People's Procuracy has just issued an indictment to prosecute 12 defendants in a case of violating bidding regulations causing serious consequences, occurring at the Tay Ninh Provincial Department of Health and related units.

Among them are Mr. Hoa Cong Hau, former Director of the Department of Health; Mr. Le Thanh Lu, former Deputy Head of the Financial Planning Department, Tay Ninh Department of Health; Ms. Hoang Thi Thuy Nga, Chairwoman of the Board of Directors of NSJ Company.

Defendant Hoa Cong Hau

According to the accusation, in July 2017, knowing that the Tay Ninh Provincial Department of Health needed to equip the Tay Ninh Provincial General Hospital with a 128-slice CT Scanner system, defendant Hoang Thi Thuy Nga and her staff went to meet with the Director of the Department of Health, Hoa Cong Hau.

Ms. Nga raised the issue of selling the CT Scanner system of Siemens Healthcare, of which NSJ Company is the official distributor.

With Mr. Hau's "green light", Ms. Nga met with Deputy Head of Financial Planning Le Thanh Lu, quoting the equipment price of over 28 billion VND.

Next, Mr. Lu asked NSJ Company to provide quotes from different companies for this type of machine, to advise the leaders of Tay Ninh Department of Health.

As requested, Ms. Nga directed her subordinates to make price quotes for 4 companies, which were actually fake.

After receiving the quotation, Mr. Lu advised Mr. Hau to sign a report to submit to the Tay Ninh Provincial People's Committee, and at the same time send it to the Department of Finance, evaluating the 128-slice CT system as having many advantages compared to other brands and proposing to accept the equipment for Tay Ninh Provincial General Hospital, at a price of about 28 billion VND.

On December 1, 2017, the People's Committee of Tay Ninh province decided to allocate additional 28 billion VND from the provincial budget for 2017 to the Department of Health to purchase a 128-slice CT Scanner.

According to the conclusion, the value of the camera provided by NSJ Company was only over 14 billion VND. Therefore, the defendants' actions caused damage to state assets of over 13 billion VND.

Notably, Mr. Hau was accused of directing and directly signing documents requesting purchase policies and organizing bidding to buy CT scanners for the provincial general hospital; and was the person responsible before the law during the bidding process to select contractors.

From 2018 to 2020, after NSJ Company won the bid, although there was no prior promise or agreement, Mr. Hau received gifts from NSJ Company 3 times, with a total value of 1 billion VND. Former Director of Tay Ninh Department of Health Hoa Cong Hau has now returned the benefit amount.

In addition to Mr. Hau, defendant Le Thanh Lu also received gifts from NSJ Company three times with a total of 600 million VND, and has now returned the entire amount.
