(TN&MT) - On October 29, in Bac Kan province, the working delegation of the Ministry of Natural Resources and Environment led by Deputy Minister of Natural Resources and Environment Le Minh Ngan had a working session with the People's Committee of Bac Kan province on state management of land and water resources.


Participating in the working delegation of the Ministry of Natural Resources and Environment are: Leaders of the Department of Land, Department of Legal Affairs, Department of Land Resources Planning and Development, Department of Land Data and Information Registration, Ministry Inspectorate and Ministry Office.

Receiving and working with the delegation, on behalf of the People's Committee of Bac Kan province, there were Chairman of the Provincial People's Committee Nguyen Dang Binh; Permanent Vice Chairwoman of the Provincial People's Council Tran Thi Loc; Vice Chairmen of the Provincial People's Committee and leaders of departments, branches and sectors.

According to the report of the People's Committee of Bac Kan province, in the past time, the People's Committee of the province has focused on directing the implementation of the Land Law 2024 and the Law on Water Resources 2023. Up to now, the People's Committee of the province has issued legal documents detailing a number of articles of the Land Law 2024 and stipulating a number of contents on compensation, support and resettlement when the State recovers land in Bac Kan province, accordingly, 11/20 contents of the Land Law have been issued and 10 contents have been issued according to Decree No. 88/2024/ND-CP.

Regarding water resources, the province has carried out the task of inventorying and evaluating water resources in Bac Kan province (first inventory), expected to be completed in 2024 to promptly report to the Ministry of Natural Resources and Environment as prescribed. Currently, the province is implementing a total of 71 water resource licenses of all kinds, of which 9 licenses are under the authority of the Ministry of Natural Resources and Environment (8 licenses for exploiting and using surface water of hydropower projects and 1 license for discharging wastewater into water sources in the province); 62 licenses are under the licensing authority of the Provincial People's Committee (13 licenses for exploiting and using underground water; 28 licenses for exploiting and using surface water; 21 licenses for discharging wastewater into water sources). In addition, the province has also granted 27 licenses for practicing underground water drilling to organizations and individuals....

At the working session, the leaders of Bac Kan Provincial People's Committee and representatives of departments, branches and sectors raised a number of difficulties and problems arising in the implementation of the Land Law such as adjusting land use planning and plans; submitting to the Provincial People's Council for approval the change of land use purpose for rice cultivation, special-use forest land, protective forest land, production forest land; land allocation, land lease, change of land use purpose; compensation, resettlement support, etc.

Regarding water resources, the province still faces difficulties in appraising and accepting water resources projects; granting licenses for water exploitation and use; sanctioning administrative violations in the field of water resources... There needs to be more specific guidance from the Ministry of Natural Resources and Environment so that localities can promptly and effectively implement them.

At the meeting, Deputy Minister of Natural Resources and Environment Le Minh Ngan and representatives of the leaders of specialized units under the Ministry of Natural Resources and Environment provided specific answers and responses based on the promulgated Laws and Decrees and Circulars guiding their implementation to clarify the issues that Bac Kan province is facing.

Speaking at the Conference, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the Land Law is an important law, affecting all aspects of the country's socio-economic life, national defense, security, and environmental protection; playing a central role in the land law system, and having a relationship with many other provisions of the law. With the strong direction of the Government and the Prime Minister, in order to ensure the conditions for the 2024 Land Law to take effect from August 1, 2024 (5 months earlier than planned), in a short time, the Ministry has actively and proactively coordinated with relevant ministries, branches, and agencies to develop and submit to the Government for promulgation 5 Decrees detailing the implementation of the 2024 Land Law to take effect in sync with the Law. At the same time, the Ministry has also issued, under its authority, the Circulars assigned in the Law.

According to Deputy Minister Le Minh Ngan, monitoring shows that despite being heavily affected by storm No. 3, the province has made efforts to develop and issue documents guiding the implementation of the Land Law according to its authority.

The Deputy Minister requested the People's Committee of Bac Kan province to continue to urgently and strictly implement the Prime Minister's telegrams and instructions, focusing on directing the full promulgation of assigned contents detailed in the Land Law and decrees detailing the implementation of the law to ensure a synchronous legal system before October 31 according to the Prime Minister's directive.

At the same time, continue to promote training, propaganda, and dissemination widely, regularly, and continuously to all levels, sectors, people, and businesses. In particular, it is necessary to pay attention to the organization of the Land Fund Development Center, the Land Registration Office, and the District Department of Natural Resources and Environment, including increasing the staffing of the District Department of Natural Resources and Environment, because the 2024 Land Law decentralizes many tasks to localities, especially the district level.

In addition, the Deputy Minister also requested attention to preparing necessary conditions, technical and economic norms related to land according to authority; related land database, applying digital transformation, strengthening state management of land...

Speaking at the end of the working session, Chairman of Bac Kan Provincial People's Committee Nguyen Dang Binh said that the province will fully absorb the instructions of Deputy Minister of Natural Resources and Environment Le Minh Ngan and the contributions of the members of the Working Group.

Chairman of the People's Committee of Bac Kan province Nguyen Dang Binh said that based on the results of the working session, the People's Committee of Bac Kan province will strengthen the direction of the Department of Natural Resources and Environment and related departments to coordinate, speed up the progress of construction and promulgation of documents guiding the implementation of the Land Law according to their authority, helping to remove difficulties for people and businesses, and speed up the disbursement of public investment capital.

At the same time, continue to focus resources on perfecting the organizational apparatus in the land sector so that the implementation of the Land Law is timely and effective.
