Harmonizing interests: State - land users - investors

The Standing Committee of the City Party Committee at the 153rd Conference, after listening to the Party Committee of the Ho Chi Minh City People's Committee report on giving opinions to request approval in principle on the necessity of adjustment and how to implement the adjustment of the Land Price List according to Decision No. 02/2020/QD-UBND dated January 16, 2020 of the City People's Committee (in Submission No. 856-TTr/BCSĐ dated August 5, 2024; Appraisal Submission No. 2574-TTr/VPTU dated August 20, 2024 of the City Party Committee Office), discussed and agreed to conclude:

Welcoming and highly appreciating the sense of responsibility of the Party Committee of the Ho Chi Minh City People's Committee, the Department of Natural Resources and Environment and relevant agencies and units for their efforts, focus and determination in researching, developing and proposing adjustments to the land price list according to Decision No. 02/2020/QD-UBND. At the same time, closely coordinating with the Ho Chi Minh City People's Council, the Vietnam Fatherland Front Committee of Ho Chi Minh City, the City Party Committee's Mass Mobilization Commission and socio-political organizations in the city to carry out the preparation steps in a democratic, public, transparent, open-minded, listening and receptive manner; the report and submission documents for the Standing Committee of the City Party Committee were carefully prepared, providing quite complete and detailed information, with statistics, presenting each option with comparison, careful analysis, proposing options and assessing multi-dimensional impacts on many groups of subjects regulated under the 2024 Land Law.

This is a very important, sensitive and complicated content, with a very large scope and subject to regulation and has an impact on organizations and individuals using land and the socio-economic situation of the city, but it must be implemented. Because, when the 2024 Land Law comes into effect, the application of the current Land Price List of the city is not in accordance with current regulations.

The adjustment of the land price list according to the report of the Party Committee of the Ho Chi Minh City People's Committee is to gradually bring the land price list in the city closer to the market price, to create favorable conditions for socio-economic activities, avoid congestion in resolving financial obligations on land for organizations and individuals and contribute to the early implementation of important projects and works of the city.

Therefore, the implementation process must be extremely careful, carefully considered, continue to monitor and evaluate the impact comprehensively, listen, absorb, research and select the most optimal solution, suitable to the actual situation of the city, minimizing the impact on the legitimate and legal rights and interests of the people, according to the motto "ensuring harmony of interests between the State, land users and investors".

Create high consensus among the people

Basically agree with the policy according to the report and proposal of the Party Committee of the Ho Chi Minh City People's Committee in the above-mentioned Submission No. 856-TTr/BCSĐ. Assign the Party Committee of the Ho Chi Minh City People's Committee to lead the City People's Committee to direct the Department of Natural Resources and Environment and related departments, branches and sectors to fully absorb the comments of the members of the Standing Committee of the City Party Committee, the Party Delegation of the Ho Chi Minh City People's Council, the Mass Mobilization Committee of the City Party Committee, especially the issues that need attention, continue to carefully review, complete, urgently deploy the implementation steps in accordance with the procedures and regulations of the law, issue the adjusted land price list and implement it as soon as possible.

In particular, it is important to pay attention to implementing a number of key issues: Strengthening coordination with the Party Committee of the Vietnam Fatherland Front and socio-political organizations of the city, the city's press agencies, localities, and mass organizations assigned by the Party and the State, especially the City Lawyers Association, to carry out a variety of propaganda documents to the people, especially those affected by the impacts, to promote communication work closely, specifically, with clear and thorough information, clearly stating the past, present and future contexts; determining that Ho Chi Minh City cannot avoid adjusting the land price list this time is for the stability and development of the city, thereby creating consensus and support in society and all classes of people before implementation.

Continue to closely follow the direction of the Government, the Prime Minister and relevant ministries and branches, especially the Ministry of Finance, to receive guidance on resolving outstanding issues as a basis for calculating financial obligations on land for records after the effective date of the 2024 Land Law.

Urgently advise on the establishment of a Steering Committee to implement this content, with participants including representatives of the Standing Committee of the City Party Committee, the Party Delegation of the City People's Council, the Party Delegation of the City Vietnam Fatherland Front, the City Party Committee's Mass Mobilization Committee, the City Party Committee's Propaganda Department and related units to ensure a tighter implementation of the steps.

At the same time, promptly research, develop and promulgate regulations and guidelines for implementation according to the 2024 Land Law and Government Decrees under the authority of the City People's Committee; proactively prepare a plan to develop a land price list according to the 2024 Land Law to apply from January 1, 2026 with a very strict roadmap and steps, not to be passive, affecting the implementation of legal policies in the city.

During the implementation process, it is necessary to proactively forecast complicated situations and handle unexpected problems. If there are difficulties or problems, the Party Committee of the Ho Chi Minh City People's Committee and agencies and units must promptly report to competent authorities for consideration and decision.
